SNOW REMOVAL CONTRACT
This snow removal agreement, herein referred to as the "Contract," establishes a legally binding understanding between the Client and the Contractor. It delineates the precise terms and conditions governing the provision of snow removal services by the Contractor to the Client.
1. SCOPE OF SERVICES
1.1. Services: The Contractor agrees to provide snow removal services for the Client's property agreed upon estimate.
1.2. Trigger Depth: Snow removal services will be initiated when the snow accumulation reaches or exceeds two (2) inches. All snow removal services will be initiated only when a snowstorm accumulates or exceeds 2 inches of snow. Anything below 2 inches will not trigger the service. If the snowstorm doesn’t accumulate 2 inches from the start to the end of the storm, then the service cannot trigger. If the storm stops for more than 12 hours it is considered finished. If it were to restart snowing within the 12-hour break period it is considered still the same snowstorm. If it starts snowing after 12 hours it is considered a new snowstorm.
1.3. Services Included: The Contractor shall be responsible for clearing snow from all designated areas on the Client's property outlined on the estimate.
1.4. Equipment: The Contractor will use appropriate snow removal equipment to complete the services in a timely and efficient manner.
1.5 Snow Plowing Clarification: While we strive to clear your driveway completely during our snow plowing service, there may be instances where certain corners or areas are difficult to reach with our equipment. If you would like these specific areas shoveled as well, please request this as an additional service when you make your snow plowing payment. If you opt for the standard snow plowing service only, we will focus on plowing from the truck and won't provide shoveling outside the vehicle.
1.6 City Snow Removal: The city operates on its own plowing schedule, which may not always align with our preferred timing. Therefore, if we plow your snow and the city conducts additional plowing afterward, we will return to clear what the city has piled up. Please note that this process may take up to 24 hours to complete and must be requested.
2. SERVICE SCHEDULE
2.1. Commencement Date: The snow removal services covered by this Contract will commence on Nov 1st and will continue throughout the winter season [ March 31].
2.2. Frequency: The Contractor will perform snow removal services as needed, based on the trigger depth of two (2) inches or more. Please read section 1.2 for more details.
2.3. If snow exceeds 10 inches of depth or more in a snowfall the client will be required to pay 5$ an inch after 10 inches
2.4 Snow Removal obstructions: Before our arrival, please ensure that your car is relocated and there are no obstructions in your driveway that could impede the snow plowing process. We may send an email before coming out to give you enough time to relocate vehicles and other items off the driveway. If we encounter any obstructions, we may attempt to navigate around them or, if necessary, return later after notifying you to move the vehicle. Please be aware that any damage to vehicles or items in the driveway during the snow removal process will not be our responsibility.
3. FEES AND PAYMENT
3.1. Payment: The Client agrees to pay the Contractor a fee of [Monthly/Seasonal/Yearly Fee] for the snow removal services outlined in this Contract.
3.2. Payment Schedule: Payment shall be made [Monthly/Seasonally/Yearly], in advance, on or before the [Payment Due Date]. The Client may choose the preferred payment method, which can include cash, check, or electronic transfer.
3.3. Late Payments: Late payments may incur a late fee of [Late Fee Amount] or [Late Fee Percentage]% of the total invoice amount.
4. TERMINATION
4.1. Termination by Client
The Client may terminate monthly contracts by providing written notice to the Contractor at least 30 days prior to the contract's due date. The Client will be responsible for payment of services rendered up to the termination date. A termination fee of $100 will apply for early termination of the contract before the agreed-upon date. Seasonal contracts may be terminated with written notice at least 30 days prior to the season's start without incurring fees. Terminations or cancellations after the season begins must be reviewed and approved by the Contractor. The Contractor reserves the right to deny termination requests made without breach of contract.
4.2. Termination by Contractor
The Contractor reserves the right to terminate this Contract by providing written notice to the Client if the Client fails to make payments as specified or otherwise breaches the terms of this Contract.
5. LIABILITY
5.1. Liability Waiver: The Client understands that snow removal services involve inherent risks, and the Contractor shall not be liable for any damages or injuries resulting from the performance of these services.
5.2 Lawn Damage: Occasionally, unforeseen challenges can result in damage to your lawn during our service. In such instances, we may take corrective action by applying topsoil and grass seeds to help restore the affected areas as a goodwill gesture. However, please understand that beyond these initial efforts, the responsibility for any further lawn care or repairs will fall on your shoulders.
6. MISCELLANEOUS
6.1. Insurance: The Contractor agrees to maintain appropriate liability insurance coverage for the duration of this Contract.
6.2. Entire Agreement: This Contract constitutes the entire agreement between the parties and supersedes all prior agreements, written or oral.
6.3. Amendments: Any amendments or modifications to this Contract must be made in writing and signed by both parties.
6.4. GOVERNING LAW: This Contract shall be governed by and construed following the laws of Minnesota.
6.5. Weather App: We will only use the AccuWeather app to track the snow report based on the report made in the city of Blaine.
By agreeing to the estimate, the parties acknowledge that they have read, understood, and agreed to the terms and conditions of this Snow Removal Contract.
7. Salting services
7.1 Salting Responsibility: The service provider agrees to perform salting services on the designated driveway, as specified in this contract, to address icy and hazardous conditions during the winter season if requested in the estimate.
7.2 Salt Type: The service provider will use appropriate de-icing materials, which may include salt or ice melt, to ensure safe and accessible conditions on the driveway.
7.3 We provide salting services on a per-time basis, and you need to communicate any specific areas on your driveway that require additional salting beyond our standard application. Unless otherwise specified, we will apply the standard amount of salt to the areas outlined in the estimate. Your prompt notification of any specific requirements will ensure that our salting service meets your needs effectively.
7.4 We want to emphasize that we are not liable for any slips or injuries that may result from our salting services. While we strive to provide effective and safe salting solutions, the responsibility for taking precautions and ensuring personal safety in areas subject to salting lies with the property owner or responsible party. It is advisable to exercise caution when walking or driving on treated surfaces to minimize the risk of accidents.
7.5 For monthly or seasonal salting services, our approach is to proactively address areas that require salt application based on visual assessments. If you notice any missed spots or believe that additional salting is needed, please inform us, and we will promptly revisit and reapply salt as necessary.
In the absence of specific requests, our standard procedure is to salt as follows:
We will apply salt as we identify areas in need of treatment during our regular inspections.
We will re-salt every two snowfalls as deemed appropriate based on our assessment of conditions.
